That said, there has been A LOT of confusion about how the program actually works since the law changed 5 times in the past two years alone (details below).

WHAT'S THIS NEW TAX CREDIT FOR?

The Employee Retention Credit (ERC/ERTC) was authorized under the CARES Act and encouraged organizations to keep employees on their payroll during the C19 pandemic (both for-profit companies & non-profit organizations are eligible).

Common Misconceptions

We didn't have a decline in revenue in 2020-21

Revenue is only one of many factors that will determine whether you qualify for ERTC. Many companies without a decline in revenue can still qualify for this refund.

We received a forgiven PPP loan in the past

Companies that have received one or both PPP loans are typically also eligible for additional ERTC funds (but the forgiven PPP loan must be factored into the calculations).

It’s too late to apply for the ERTC refund

Employers can technically amend their 941x forms for a period of up to 3 years after the original filing. (Based on the current legislation, but the backlog is also getting worse).

We didn't fully shut down our operations

The ERTC tax incentive has several provisions that make it possible for employers who were only partially shut down to still qualify. (Likewise, supply chain issues and delays can create eligibility as well).

Our business was (or was not) essential

Your business or nonprofit did not have to be deemed essential (or vice versa) to qualify for ERTC. The IRS anticipated that 70% - 80% of ALL US small businesses and nonprofits would be eligible.

Our revenue actually went up significantly

Government-mandated lockdowns impacted a lot more industries and states across the country, so even the organizations that did very well during the pandemic can be eligible for this refund.

Frequently Asked Questions

How do I 'use' a tax credit? How will this benefit my company?

Although it is technically called a "tax credit" it is most frequently received as a cash payment from the IRS. There is also no dollar limit for how much a business can receive, and zero requirements for what you spend it on.

Is this just for small businesses? We're a nonprofit organization.

Because the credit is based on W2 payroll taxes, most nonprofits are eligible as well. This is an incentive program to refund many of the payroll taxes paid in 2020 and 2021 to employers who were able to retain their employees.

How long will this program be available?

While (in theory) these tax credits should continue being retroactive for 3 years, there's also no guarantee how long the funding for this will be available or if the legislation will change again (Congress has modified it five times in the past 2 years alone).

Do I ever have to pay back the ERTC refund?

Nope. The employee retention tax credit is not a loan. It is a payroll tax credit, and most commonly received as a refund check back to the business. Therefore, you do not have to pay it back & you can spend it on anything.

Can I receive ERTC funds for Q4 2021?

Not at the moment, but hope is not lost yet. There is a movement by politicians to bring back Q4 2021 but currently, wages paid after September 30, 2021, are no longer considered eligible wages for ERTC purposes.

What if we provided health insurance?

If you provided your employee with $10,000 in Q1 2021 in addition to $500 for health insurance. In that scenario, your ERTC will be 70% of the sum of the qualified wages & health insurance. Therefore, the total would be $7,350.

I thought the ERTC was only available in 2020?

The American Rescue Plan extended the ERTC to the end of 2021 (now ending 9/30/21), with the passing of the Infrastructure Investment and Jobs Act). For 2021, eligible employers can get a credit equal to 70 percent of qualifying wages per quarter. The max credit per quarter is $7,000 per employee. (i.e. A lot more than 2020's credit).

Am I still eligible if I applied for another tax credit or a PPP loan?

Yes, there's a very good chance you could be eligible. As of December 2020, the Consolidated Appropriations Act (CAA) made a provision that allows businesses that took out PPP loans to still qualify. However, the number of qualified wages depends on your PPP loan forgiveness application & calculation.

How long will it take for me to receive my ERTC credit or refund?

That depends on the IRS backlog, and at present, the minimum expected wait time to receive your ERTC credit from the IRS is about 6-9 months. The actual calculation of the credit depends on who does them, but it typically takes most ERTC firms 2-4+ weeks to confirm everything & calculate the total refund.

So who is an Eligible Employer? And what is the qualifying criteria needs to approved?

Eligible Employers for the purposes of the Employee Retention Credit are those that carry on a trade or business during calendar years 2020 & 2021 (including tax-exempt organizations) that either:


1. Fully or partially* suspended operations by a governmental order (AND/OR)

2. Experienced a significant decline in gross receipts during a calendar quarter


*It would probably be a good idea to get specialized advice about this. (And possibly even a 2nd opinion if needed). An organization can be considered "partially suspended" if a state or local mandate imposed restrictions by limiting commerce, travel, or meetings (for social, commercial, religious, or other purposes). This can be a "Stay at Home" order, limited indoor or on-site access, limited or canceled in-person meetings and other capacity restrictions, reduced operating hours, delayed production timelines due to supply chain issues, or several other possibilities you should seek personal advice on.
